Los Angeles - An adoption case in South Carolina is gaining national attention after a two-year-old girl was taken away from the people who adopted her at birth.
Veronica Capabianco's biological father is Cherokee... and last January, he signed a form giving up all rights to his daughter and agreeing not to contest the adoption.
He then changed his mind and began petitioning to get her back.
A federal law from 1978 protects American Indian families from being separated... In November, a court ruled that "The Indian Child Welfare Act" trumped any other law... and Matt and Melanie Capabianco were ordered to turn over their daughter.
An attorney for the biological father released a statement saying:
"My client has been fighting for custody of his child since shortly after the child's birth. He loves this child with all his heart... it is important to understand that the Indian child welfare act was not used as a loophole in this action. The family court followed both state and federal law."
On Thursday, Stacey Doss... an adoption rights advocate - who last year won a highly publicized battle for her adopted daughter - joined us live for a discussion on the Capabianco's adoption battle.
