Los Angeles (myFOXla.com) - A federal judge overturned the conviction of a man serving a life sentence for a gang shooting in East Los Angeles.
U.S. District Judge Gary Feess ruled last week that 34-year-old Rafael Madrigal Jr.'s attorney didn't present evidence that he was at work more than 30 miles away at the time of the shooting in July 2000.
Madrigal was convicted in 2002 of attempted murder for shooting a man in the head during gang-related violence.
Feess ruled Madrigal should be retried or released from prison where he's serving a 53-years-to-life sentence.
State attorney general spokeswoman Christine Gasparac said she was unsure whether the decision will be appealed.
Meantime, Madrigal had an emotional homecoming on Tuesday.
