Holmes arraignment Monday in theater shooting

Another day in court Monday for James Holmes, the suspected Colorado gunman will be arraigned for shooting 70 people in a crowded theater -- killing 12.

Legal analysts say Holmes' attorneys will likely use an insanity defense at trial. But his attorney's say, leaks about that package sent to his psychiatrist may have jeopardized his right to a fair trial, saying the notebook contained communications between Holmes and his doctor that should be shielded from public view.

On Friday, attorneys for 24-year-old James Holmes admitted he was a "psychiatric patient" of Dr. Lynne Fenton.

Before the theater massacre, Holmes sent her a notebook with descriptions of an attack, the first indication he may have sought help before the deadly rampage. Dr. Fenton never received that package.

And court documents don't reveal when Holmes began seeing Fenton, or whether he was being treated for a mental illness. Holmes could also face charges for booby trapping his apartment. There will be no cameras in the courtroom when he's formally charged Monday.

More funerals were held over the weekend for those killed during the massacre. Five victims remain in critical condition and 11 others are still undergoing treatment. Meanwhile, the victim-mother of the little 6-year-old girl killed has suffered a miscarriage. Ashley Moser was eight weeks pregnant with her second child when she was shot in the neck and the abdomen.
