"That's what prisons were built for, guys like this," said Eric Smith.
The Macomb County prosecutor is standing up to the Michigan Parole Board trying to keep two time rapist, 57-year-old Paul Jobak (pictured above), behind bars.
"He's already committed a sex offense, served four years out of Oakland County, then nine months after getting out does this rape in Macomb County. So we know he's a habitual re-offender," Smith said.
Jobak's crimes were way back in 1985 and again in 1990. He was sentenced to 20 to 45 years. He's only served the minimum, and Smith said even the Department of Corrections feels he'll likely do it again.
"He has a high likelihood of re-offending, so why let him out?"
The details of Jobak's previous crimes are too graphic to explain here, but Smith detailed the basics.
"The first rape he committed in Oakland County he used a knife. Then in this rape in Macomb County at her home abducted her, threatened to kill her and committed three counts of CSC 1, which are life felonies."
Smith said he raped a complete stranger, a woman picked at random, attacked in the driveway of her home in Warren.
"I live in Macomb County. The judges live in Macomb County. I don't know where these parole board members live that they want guys like this walking the streets."
Smith cited a longtime problem with the parole board. He said they're way too lenient because of budget problems.
"You say yes to this guy, who do you say no to?" he remarked. "This is not the way to save money."
The case is scheduled for court on Tuesday. The prosecutor hopes the judge will agree Jobak is not fit to walk the streets.
Smith said prosecutors have been successful in the past with similar cases because the judges realize how serious this is.
"They have the option of keeping this guy behind bars for another 20 years," Smith said. "This is a guy that should be behind bars."
