Man fatally shot father, wounded brother in Joliet

JOLIET, Ill. (Sun-Times Media Wire) -

Police say a man shot his father to death and severely wounded his brother, who then returned fire and killed him during an argument Saturday night in southwest suburban Joliet.

Police were called at about 9:29 p.m. Saturday to 122 E. Cass St. in Joliet, where the gunfight unfolded, chief Mike Trafton said.

They found 23-year-old Fernando Gutierrez on the sidewalk with a revolver near him, Trafton said. He had been shot twice.

Police found Fernando Guitierrez's 46-year-old father, Roberto Gutierrez, and his 22-year-old brother both shot inside the second-floor apartment, Trafton said. Police have not released the younger brother's name.

Trafton said the younger brother, who lives in Addison and had just turned 22 on Saturday, was shot several times. A .45-caliber pistol was found inside the apartment.

"For an unknown reason, Fernando Gutierrez pulled out a gun and started shooting ... striking his brother and father. Despite the wounds, his brother went into a different room and came back returning fire," Trafton said.

Trafton declined to say if anyone else was present in the apartment during the firefight.

Trafton said although evidence and interviews are still being reviewed by investigators and the Will County State's Attorney's office, it appears the surviving brother's actions were justified.

Roberto Gutierrez, who had been laying on the couch, was taken to Provena Saint Joseph Medical Center in Joliet, where he died at 10:20 p.m., Will County Chief Deputy Coroner Bob Brenczewski said. Fernando Gutierrez was taken to Silver Cross Hospital in New Lenox, where he died at 10:12 p.m., Brenczewski said.

The younger brother is expected to survive, according to reports.
