NEW YORK (MYFOXNY) -

The mother of a man who was accidentally shot and killed by a NYPD officer plans to sue.

20-year-old Reynaldo Cuevas was shot last September when police responded to a bodega robbery. Cuevas was working inside and ran out when three armed robbers held up the store.

Cuevas was shot when he ran into Officer Ramysh Bangali outside the store.

Ana Cuevas and attorney Sanford Rubenstein spoke Saturday on Franklin Avenue in the Bronx and were joined supporters before marching to the Precinct of Officer Bangali.

Bronx District Attorney Robert Johnson says Officer Bangali won't be charged in connection with Cuevas death.

Ana Cuevas plans to sue for wrongful death.
