Missing girl's family to sue CPS, state of Arizona for $10M

PHOENIX -

The family of Jhessye Shockley, a missing child from Glendale, has filed a wrongful death suit -- not against the girl's mother who is in jail in connection with Jhessye's death -- they're suing the state.

5-year-old Jhessye was reported missing back in October 2011.  Her body has never been found.

Police believe her mother, Jerice Hunter, killed Jhessye and put her body in a Tempe dumpster -- before reporting her missing.

On Wednesday, the family's attorney announced they are suing the state and Child Protective Services for $10 million.

The claim is a precursor to a lawsuit. It alleges that gross negligence by the state, CPS and police led to the "wrongful" death of Jhessye.

Hunter is awaiting trial on charges of first degree murder and child abuse.
