A Fulton County Superior Court judge has thrown out a petition challenging the governor's decision not to appoint a panel to consider the suspension of Clayton County Sheriff Victor Hill, who is under indictment.
Judge Kelly Lee on Monday said Georgia law regarding the governor's obligation to appoint a review commission to look into the suspension of an indicted public official appears to apply when the official is indicted while in office.
Hill was sheriff from 2005 until 2008, when he lost re-election. He was indicted in February 2012 on charges related to his time as sheriff. He then beat the incumbent sheriff in the 2012 election.
A lawyer for Clayton County resident James Buckman, who challenged the governor's decision, said they will likely appeal to the Georgia Supreme Court.
