Ga. Supreme Court to rule on DeKalb school board case

The Georgia Supreme Court will decide if the governor has the right to remove school board members.

In February, Gov. Nathan Deal issued an executive order removing then-DeKalb County school board chairman Eugene Walker and five other school board members.

Walker said that Deal's order was unconstitutional.  He is using his own money to fund the legal fight to get his job back.

Both sides argued their case for 20 minutes before the Georgia Supreme Court on Monday.

The state's senior attorney, Stefan Ritter, told the judges that the governor made his decision after the Southern Association and Colleges and Schools placed DeKalb Schools on probation for the board's money mismanagement and unethical conduct.

"This statue is about protecting the schools and the children in the schools," said Ritter. "The answer to that question is some sort of conduct, even if it is merely negligent conduct that would lead to the potential loss of accreditation, that is sufficient."

Ritter went on to say the six former board members had an extensive hearing before the state school board and will have a second individualized hearing before permanent removal is an option.

But Walker, the only former board member to show up at the Georgia Supreme Court, said he's in this for the long haul.

"If I win -- good. If I lose, I'm going to keep fighting. God is good," Walker said.

The judges are expected to make a decision on the case by November.

FOX 5 has learned that five of the six ousted board members will have individual administrative hearings beginning next week. Only former board member Nancy Jester does not have an administrative hearing scheduled.
