City to pay $90K to settle age discrimination claim

The city of Atlanta is going to pay $90,000 to a veteran fire department manager who says he was demoted because of his age.

Deputy Chief Anthony Davidson, then 52, said he always received outstanding evaluations. He said he was told he was being demoted because the department was "moving in a different direction."

Davidson said his demotion was age discrimination; someone 10 years younger got his position.

City attorney Eric Richards told Atlanta City Council members on Tuesday that while the intent may not have been to discriminate, a substantial number of facts were present to settle the case.

"There were issues with the way the personnel action was carried out and for that reason we recommended a settlement in the amount of $90,000," said Richards.

There is no cut-off age to be a firefighter.
