Activists' suit challenges Ariz. law as too broad

PHOENIX (AP) - A lawsuit filed on behalf of homeowner activists contends the Arizona Legislature unconstitutionally inserted legislation on homeowner associations in an elections bill.

The lawsuit contends that the bill violated the Arizona Constitution by including legislation on more than one subject in the same bill. It also contends the bill's title doesn't disclose that the altered bill included the homeowner association legislation.

Republican Rep. Michelle Ugenti of Scottsdale sponsored the bill that was the source of the HOA legislation inserted into the elections bill. She says House staff determined that some provisions made her amendment related to the election legislation.

The Arizona Capitol Times reports that the Arizona Center for Law in the Public Interest filed the suit Tuesday in Maricopa County Superior Court on behalf of the activists.
