Judge drops DUI charge in Lilburn fatal hit-and-run

GWINNETT COUNTY, Ga. -

A Gwinnett County judge has dismissed a DUI charge against a man charged with killing a mother and daughter in Lilburn.

Donning a green jumpsuit, Spencer T. Prigmore, 43, said little when he went before a Gwinnett County judge Thursday.

Prigmore's attorney, Tom West, argued that there was no evidence that his client was under the influence of alcohol or drugs at the time of the accident. Authorities said that Prigmore denied a field sobriety test that night, but blood was drawn and sent to the GBI for analysis.

The judge dropped the DUI charge for lack of evidence, but that charge could be reinstated pending the results of the blood test. Prigmore still faces two counts of vehicular homicide, hit-and-run/failure to stop and reckless driving, according to the Gwinnett County Sheriff's Department.

Several of Prigmore's family members -- including his mother and ex-wife -- attended the court date. The presiding judge requested Prigmore's mother take the stand, where he asked her several questions about her own life and her son's. She stated she lives with and looks after her parents.

Tears flowed freely from Prigmore's relatives as the judge and attorneys recalled the horrific series of events that led to Maria Alicia Cervantes Maldonado and Melissa Paola Cervantes' deaths.

Police say the large white pick-up truck Prigmore drove jumped the curb traveling southbound on Lawrenceville Highway, just past Harbins Road, last Thursday. The vehicle struck Maldonado and her daughter – and kept on going.

Lilburn Police Capt. Thomas Bardugon said, "Officers arrived on the scene and they found an adult female and a child...on the side of the road there. The vehicle had struck them and left the scene and continued southbound on Lawrenceville Highway."

Lilburn police determined Prigmore's truck struck Cervantes Maldonado and little girl as he tried to pass a car traveling southbound on Lawrenceville Highway.

Police say Prigmore and his female passenger were stopped about a quarter-mile from the accident scene at a check cashing place. They were taken into custody there and to police headquarters for questioning. The passenger was released without charges being brought against her. Her name was not released, either.

The judge denied bond to Prigmore on Thursday.

Friends and family of the victims held a vigil Thursday night.
