PHOENIX (AP) - A judge is considering whether to set bond for a woman whose conviction for killing her son more than two decades ago was overturned by an appeals court.

Lawyers for Debra Milke urged Maricopa County Superior Court judge Rosa Vroz on Friday to set bond at $50,000. They say the evidence against her is flimsy at best and there's doubt about whether key witnesses will even testify in a new trial.

A prosecutor told Vroz the evidence that used to convict Milke of 1st degree murder for the 1989 death of her son is intact and she should remain in jail pending a new trial. Barring that, he asked for $5 million bond.

Milke spent more than 22 years on death row before the conviction was thrown out in March.
