Lawsuit over NuvaRing contraceptive

More than 3,600 women from across the country are suing Merck. Lawyers say more than a 100 women have died from using the NuvaRing birth control. Lawyers want the drug maker to properly label the contraception to let women know of the increased dangers.

Attorney Hunter Shkolnik is representing women from across the country who are suing pharmaceutical company Merck, which makes the NuvaRing contraceptive. It has been on the market for about 12 years. The women claim the NuvaRing caused blood clots, and in some of these cases the clots resulted in death.

Shkolnik says Merck has failed to include on the label and also failed in talks with doctors to say that it can have up to five times the risk compared to the pills.

Doctors say all birth control pills have the potential to cause blood clots and stroke.

Shkolnik says they are not asking Merck or the FDA to take the NuvaRing off the market. What they want is for Merck to strengthen its label letting patients know they are more at risk of blood clots with the NuvaRing than they are with traditional birth control pills.

Shkolnik also says the FDA is being negligent for failing to require Merck to change its warning label.

Merck issued this statement to Fox 5: "Nothing is more important to Merck than the safety of our medicines and vaccines and the people who use them. … We stand behind the research that supported the approval of NuvaRing, and our continued work to monitor the safety of the medicine."

We contacted the FDA on Tuesday. The agency referred us to its website. We checked that out, found it confusing, and needed clarification. I called three different people with the FDA on Thursday. None of them got back to me.

    Police on Long Island say one person has died and another has been seriously injured in a skydiving accident.
