Police Arrest Mechanic In Fatal Delco Hit And Run Accident

UPPER DARBY, Pa. -

A man police say is responsible for a deadly hit-and-run that killed a man and his dog is now in custody. The accused driver turned himself in.

"Here's an individual who should not be behind the wheel of a car."

Those words from investigators as 58-year-old Earnest Marks was lead off to jail. Police say he was the driver of a car when it plowed into 69-year-old Richard Patterson Sunday evening as the retired carpenter walked his dog "baby" to his home just a block away.

"He didn't stop because he was under suspension. His driving record over the years shows that he has had 11 motor vehicle suspensions," Upper Darby Police Superintendent Michael Chitwood said.

Chitwood says Marks admitted his involvement and told investigators he didn't know he hit Patterson until he saw news reports and video of his car the next day. He stashed the heavily damaged car in the 800 block of North 47th street in West Philadelphia just around the corner from his Felton Street home. He surrendered to police on Tuesday after his attorney contacted investigators.

"To say that he didn't know what he hit, but he knew he hit something is absolutely ludicrous in my mind," Chitwood added.

Detectives say Marks was traveling 50 to 60 miles per hour in a 35 mph speed zone when he struck Patterson as he crossed the street with his poodle. Patterson, a husband and father of three, was dragged 50 feet. The poodle was also killed. Marks is now charged with causing an accident involving death, driving while suspended and other counts.

"He admitted responsibility. He knew all the facts of the case. He was driving a 2000 white Acura," Chitwood explained. "Killing somebody and then leaving them laying on the highway without any stop, that's murder."

Patterson's family was notified of the arrest immediately. They have not spoken with the media. Chitwood says police are carefully examining the 2000 white Acura's heavy front end damage. The bumper from the car is still missing. Charges could be upgraded when the investigation is complete.

"The charges for these individuals who leave people dead or maimed on the highway stink. They stink," Chitwood said.

Chitwood says Marks uses eight aliases. He has a probation violation for a drug conviction and eight prior arrests, mostly for drugs.

Marks could get two to three years in prison on the current charges, but police are still investigating trying to determine where he was and what he was doing prior to the fatal accident. They are also awaiting the results of toxicology tests.

Marks was being held on $1 million cash bail. His attorney did not return our phone call seeking a comment on the case.
