DUI Driver Will Not Be Charged In Teen's Death

LEVITTOWN, Pa. -

Cops say a driver accused of hitting and killing a Bucks County teen and injuring another while driving under the influence of prescription drugs and cocaine will not be charged.

So why does the DA's office say it can't charge him in the teen's death?

Family members say it's a miscarriage of justice.

Fox 29’s Sabina Kuriakose reports.

Police tape still marks the spot along Route 13 where police say 15-year-old Zachary Gonzalez was struck and killed while riding his bike with his friend 3-months ago.

Now grief is turning into rage as victim’s family members learns the driver will not face charges in the teenager's death.

“After two children went over your windshield that's what you cared about? And the DA doesn't think that's enough evidence," Sarah Hughes, whose son was injured in the crash.

Raw rage after Sarah Hughes learns the driver who police allege struck her son and his friend as they rode their bikes along this stretch of Route 13 in Levittown in January will not face charges for injuring her son, and killing his friend 15- year-old Zachary Gonzalez.

Jeffrey struggles every day.

Sarah says her son is still dealing with the aftermath of the crash and wasn't ready to talk on camera.

Prosecutors say 60-year old Brian Patterson was driving under the influence of prescription drugs and cocaine the afternoon he allegedly hit the boys, but they say they don’t have enough evidence to prove the drugs had anything to do with the crash.

“Multiple witnesses to the crash confirmed the victim entered the road way on his bicycle and the defendant did not have any time to react and avoid the crash," Bucks County Assistant District Attorney Matt Hoover said.

Fox 29 tracked Patterson to his home in Bristol.

He wouldn't talk to us about the crash.

We also found that Patterson has a history of drug and DUI charges dating back up to 15 years, including pleading guilty to driving while his operating privileges were suspended about a week before the January crash.

“He hit somebody and they're no longer here. And he hurt my child and that's not ok and I want to know why he's not getting charged with that,” Hughes said.

If convicted Patterson faces a mandatory 3-day jail sentence and up to one year in prison for each of the two drug possession charges.
