Charges dropped again against Detroit mother

Posted: Updated:
(WJBK) - Charges have been thrown out again for a Detroit mother who's been in and out of court since 2011. She was accused of firing shots at police when they came to remove her daughter from their home under orders from the state.

Judge Gregory Bill affirmed a lower court ruling that dismissed charges of felonious assault, resisting arrest and felony fire arm against Maryann Godboldo for the second time now.

The case dates back to March of 2011 when state officials determined her daughter, who was then 13 years old, was at risk after she was taken off her medication Godboldo thought was dangerous and deadly.

When police went to her home to remove her daughter Godboldo refused to let them in and when the gunshot was fired inside her home that was the beginning of a 12-hour standoff with police.

Again, adding that the order to remove the child wasn't valid.

"She was not certain whether the seal was the county's official seal and that the time stamp was not a stamp that the county used," said Judge Bill.

Prosecutors insist she did fire a shot toward police and that she should be charged. Her attorney says prosecutors can appeal within 90 days and expects that will happen.
